Public Hearing on Vaccination Registry

Below are just a few of the major issues with this rule change and guidance on taking action, provided courtesy of RebuildNH ––

1. The proposed rules expands the unconstitutional Vaccine registry.   In 2018, 409,325 people or 81% of the NH voters voted to adopt Art. 2b:

[Art.] 2-b. [Right to Privacy.] An individual’s right to live free from governmental intrusion in private or personal information is natural, essential, and inherent.”  

This proposed rule change violates this constitutional amendment because the rules would allow private and confidential health information to be shared with both public and private groups. Creating and expanding a database designed to track people from birth to death is a clear violation of this constitutional protection that was put in place just 2 years ago.

2. From the cover page of the proposed rules: “The registry tracks vaccinations that health care providers administer to patients in New Hampshire in order for important vaccination information to be shared among health care providers, schools, child care agencies, pharmacists, public health departments, and state agencies…”  As others have said, George Orwell’s novel 1984 was not intended to be a road map for NH:

“Nineteen Eighty-Four, often referred to as 1984, is a dystopian social science fiction novel by the English novelist George Orwell. It was published on 8 June 1949 by Secker & Warburg as Orwell’s ninth and final book completed in his lifetime. Thematically, Nineteen Eighty-Four centers on the consequences of totalitarianism, mass surveillance, and repressive regimentation of persons and behaviors within society..”

3. DHHS wants to add “childcare centers, colleges, and universities,” to the list of public and private organizations that have read access to this ‘private and secure database’.  Are you worried that your private daycare, school or college will force your child to get a Covid injection and/or continue to get the semi-annual covid-shots?  Here is your chance to weigh in on this massive expansion of government control of you and your families lives.

4. All newborns to be enrolled into the system.  Changes to the definitions will mandate that even those who want to have their children at home with midwives will end up with their children enrolled into the system. This is a prime example of government reaching into your bedroom…

“Birthing facilities shall enroll all newborns in the registry through submittal of the electronic birth certificate (EBC) to the Division of Vital Records Administration Registration/Certification.

(c) When enrolling a newborn, birthing facilities shall record and report information about any vaccine or biological administered at the birthing facility on the EBC prior to the discharge of the newborn.
(d) If the birth of a newborn takes place outside of a birthing facility and the newborn is then transferred to a birthing facility, the receiving birthing facility shall enroll the newborn in, and inform the parent about the registry.”…

5. They are removing critical opt-out provisions: Not only are they eliminating critical opt-out clauses, the change will allow the names of those who opt-out to be added into the registry and will remove the prohibition on entering names into the registry.   The following text is being deleted from these rules:

“(b) No patient’s immunization/vaccination information shall be entered into the registry without that patient, or the patient’s parent or guardian if the patient is a minor, being given the opportunity to opt out of the registry.

(c) No health care provider shall provide to the department or to the registry the name of, or any immunization/vaccination information relating to, any patient who opts out of participating in the registry, except as required by RSA 141-C:9.”

They are removing critical opt-out provisions:Not only are they eliminating critical opt-out clauses, the change will allow the names of those who opt-out to be added into the registry and will remove the prohibition on entering names into the registry.   The following text is being deleted from these rules:
